법치주의에 부합하는 (형사)법학 연구ㆍ교육의 합리적 방향 - 구조 문제를 중심으로 -

초록

This article contains suggestions for revision of relevant laws and improvement of systems regarding the rational direction of criminal law education and research in accordance with the principles of the rule of law and Rechtsstaatlichkeitsprinzip. Seventeen years have passed since the introduction of the Law School in 2009 in our country. From a rule of law perspective, this paper presents a draft overview of the current state of our legal education and research, the issues requiring improvement or reform, and the legal and institutional solutions to address these issues. Above all, national protection is necessary to ensure that the cultivation of theoretical law(Rechtswissenschaft) and the supply of theoretical legal scholars(Wissenschaftlerin, Wissenschaftler) are not interrupted, and the revival of undergraduate law studies is necessary to maintain the tradition of legal education and theoretical legal studies that can maintain the civic qualities of a country governed by the rule of law. In order to preserve the legacy of local universities and prevent their extinction, the law school entrance examination system must be improved to ensure that the undergraduate programs at local universities maintain a certain level. To improve this system, it is necessary to revise several provisions of the current law on the establishment of law schools( 법학전문대학원 설치・운영에 관한 법률 ). I hope that this article will provoke relevant discussions and lead to more in-depth and concrete discussions on institutional reform.
